1. Acceptance of Terms
By accessing or using the Ghost Vine website (the "Site"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site.

3. Account Creation and Security
• Eligibility: Users must be at least 18 years old to create an account.
• Account Information: Users must provide accurate and complete information during account registration. Users agree to update their information promptly if there are any changes.
• Account Security: Users are responsible for maintaining the confidentiality of their account information, including their password. Users agree to notify Ghost Vine immediately of any unauthorized use of their account. Ghost Vine is not liable for any loss or damage arising from user failure to protect their account information. We recommend using strong passwords and practicing common-sense password security.
• Fake Accounts: Ghost Vine reserves the right to terminate any accounts that are suspected to be fake or fraudulent. We may pursue all legal ramifications, including but not limited to seeking financial damages, against individuals or entities that create fake accounts for malicious purposes.
4. User Conduct
• Prohibited Conduct: Users are prohibited from:
o Using abusive language or harassing other users.
o Engaging in any illegal activities.
o Attempting to interfere with the operation of the Site.
o Posting any personal identification documents or sensitive financial information of others.
• Content Monitoring: While Ghost Vine does not monitor or regulate speech, we reserve the right to remove any content that violates these Terms or is otherwise objectionable at our sole discretion.
5. Booking and Payments
• Booking System: Users can book locations through the Site. Ghost Vine acts solely as an intermediary platform. All payments and related issues are handled directly by the respective properties.
• Financial Transactions: Ghost Vine is not responsible for any financial transactions between users and third-party sites. This includes, but is not limited to, bookings for events, investigations, merchandise, reservations, or accommodations through any third-party locations or properties not owned or operated by Ghost Vine.
• Liability: Any issues related to payments should be addressed directly with the respective property or third-party site.
6. Privacy and Data Collection
• Privacy Policy: A separate Privacy Policy is available and is hereby incorporated by reference into these Terms.
• Data Collection: Ghost Vine collects data on properties visited, searched, or booked, frequency of visits, user satisfaction, and other site-related data.
• Data Usage: Ghost Vine reserves the right to share and sell data within legal limits in the United States. Personal data such as names, sex, or specific locations will not be sold. Data will be used for marketing purposes and will not be shared between users.
7. Intellectual Property
• Rights: All content on the Site, including text, graphics, logos, and images, is the property of Ghost Vine or its content suppliers and is protected by intellectual property laws.
• User Content: By submitting feedback or other content, users grant Ghost Vine a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, and display such content.
8. Dispute Resolution
• Governing Law: These Terms are governed by the laws of the state of Pennsylvania, without regard to its conflict of law principles.
• Arbitration: Any disputes arising from these Terms or the use of the Site shall be resolved through binding arbitration in Pennsylvania. Users waive their right to participate in class actions.
9. Modifications to Terms
Ghost Vine reserves the right to modify these Terms at any time. Users will be notified of any changes through the Site. Continued use of the Site after changes constitutes acceptance of the new Terms.
10. Termination
Ghost Vine reserves the right to terminate user accounts for any reason, including but not limited to violations of these Terms or any applicable laws or regulations. Termination may occur without prior notice.
11. Third-Party Links
The Site may contain links to third-party websites. Ghost Vine does not endorse, control, or assume responsibility for the content, practices, or policies of these third-party sites. Users acknowledge and agree that Ghost Vine is not liable for any damage or loss caused by or in connection with the use of such links.
12. Limitation of Liability
To the maximum extent permitted by law, Ghost Vine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Site, even if Ghost Vine has been advised of the possibility of such damages.
13. Data Accuracy
Ghost Vine strives to confirm the accuracy of data related to locations, including addresses, websites, and phone numbers, to the best of our abilities. However, Ghost Vine does not guarantee the absolute accuracy of such information and is not liable for any errors or omissions.
14. Indemnification
Users agree to indemnify, defend, and hold harmless Ghost Vine, its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:
• Use of the Site.
• Violation of these Terms.
• Violation of any rights of a third party.
15. Special Provisions
• Mobile and Other Devices: Users acknowledge that their carrier's normal rates and fees, such as text messaging and data charges, will still apply.
• Payments: If users make a payment on Ghost Vine, they agree to our Payment Terms, which are incorporated herein by reference.
• Developers/Operators: If you are a developer or operator of a platform application or website, you agree to our Developer Policies, which are incorporated herein by reference.
• Advertisements and Commercial Content: Users give Ghost Vine permission to use their name, profile picture, content, and information in connection with commercial, sponsored, or related content served or enhanced by Ghost Vine. This includes allowing businesses or other entities to pay Ghost Vine to display user content without any compensation to the user.
16. Miscellaneous
These Terms constitute the entire agreement between you and Ghost Vine regarding your use of the Site. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable. Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
